Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Photogram mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years of age to use Photogram. By using the App you represent and warrant that you meet this requirement. If you are under 18, you confirm that you have obtained parental or guardian consent.

3. Account Registration

Photogram uses Google Sign-In for authentication. By signing in you agree to Google's Terms of Service in addition to these Terms. You are responsible for all activity that occurs under your account.

4. User Content

4.1. You retain ownership of any photos or content you upload ("User Content").

4.2. By uploading content, you grant Photogram a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote your content within the App and on associated marketing materials (e.g., the landing page).

4.3. You represent and warrant that your User Content does not infringe any third-party rights and complies with all applicable laws.

4.4. You must not upload content that is illegal, harmful, hateful, obscene, or that infringes the intellectual property rights of others.

5. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose.
• Upload malware, viruses, or any harmful code.
• Attempt to gain unauthorized access to any part of the App or its servers.
• Scrape, harvest, or collect other users' data without consent.
• Impersonate any person or entity.
• Harass, threaten, or abuse other users.

6. Intellectual Property

All design, code, trademarks, and non-user content in the App are owned by or licensed to Photogram. You may not reproduce or distribute any part of the App without prior written permission.

7. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PHOTOGRAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

10. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify users of material changes via the App.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Photogram operates, without regard to conflict of law principles.
